Terms Of Service

Terms and Conditions

1. Agreement

By hiring Elite Mechanical Services, LLC, the customer agrees to the following Terms and Conditions. These Terms are legally binding and governed by the laws of the State of Maryland.

2. Scope of Work

All work will be performed as described in the written estimate, invoice, or service agreement.
Any additional work requested by the Client that is not included in the original agreement will require a separate estimate and additional charges.
The Company reserves the right to decline work that is unsafe, unlawful, or beyond the Company’s expertise.

3. Pricing & Payment

Written estimates will be provided before work begins unless emergency service is requested.
Payment is due in full upon completion of work, unless otherwise agreed to in writing.
Late payments may incur a [insert %] monthly finance charge.
Refund checks are subject to a $35 fee plus any collection costs.
The Company reserves the right to withhold further services until outstanding balances are paid.

4. Warranty

Elite Mechanical Services, LLC provides a 30-Day Workmanship Warranty on all labor performed and parts installed.
This warranty covers defects in workmanship and parts installed only. It does not cover:

Normal wear and tear

Negligence, misuse, or improper maintenance by the Client

Manufacturer defects in equipment or appliances (covered by manufacturer warranty only)

Failures caused by third-party work, weather, or natural disasters

All warranty claims must be submitted in writing within 30 days of service completion.

5. Limitations of Liability

The Company shall not be held liable for indirect, incidental, or consequential damages, including but not limited to loss of use, lost income, property damage, or business interruption.
The Client acknowledges that all mechanical systems (HVAC, appliances) are subject to failure, and the Company cannot guarantee performance beyond the scope of workmanship.
The Company is not responsible for pre-existing conditions, hidden defects, or issues that are not visible at the time of service.

6. Client Responsibilities

The Client must provide safe and reasonable access to the worksite, utilities, and equipment.
The Client must secure pets, children, and valuables during service.
Delays caused by restricted access, unsafe conditions, or interference may result in rescheduling and additional charges.

7. Permits & Code Compliance

Work will be performed in compliance with applicable Maryland building codes and regulations.
The Client is responsible for permit costs, inspection fees, and approvals.

8. Cancellations & Rescheduling

Cancellations must be made at least 24 hours before the scheduled service.
Same-day cancellations may result in a service fee of up to 35% of the job cost.

9. Indemnification

The Client agrees to indemnify and hold harmless Elite Mechanical Services, LLC, its employees, and subcontractors from any claims, damages, or expenses resulting from the Client’s negligence, misuse of equipment, or failure to follow recommendations.

10. Governing Law & Disputes

These Terms are governed by the laws of the State of Maryland.
Any disputes must be submitted in writing within 30 days of service completion.
Both parties agree to attempt good-faith mediation before pursuing legal action.

11. Entire Agreement

These Terms and Conditions, together with the signed proposal, invoice, or estimate, form the complete agreement between the Client and Elite Mechanical Services, LLC.
No verbal agreements are binding unless confirmed in writing.
